Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your access to and use of the FormShare software-as-a-service offering (the "Service") and the FormShare Collect mobile application (the "App"), each provided by QLands Software Inc., a Pennsylvania corporation ("QLands", "we", "us", or "our"). This AUP applies to all users of the Service and the App, including account owners, administrators, collaborators, and end users (collectively, "Users").

By using the Service or the App, you agree to comply with this AUP, our Terms of Service, Business Terms (if applicable), and Privacy Policy.

1. Permitted Use

You may use the Service and the App only for lawful purposes and in accordance with applicable laws and regulations. You are responsible for ensuring that your use, including any data collected, uploaded, processed, or shared, complies with all applicable legal and ethical requirements.

2. Prohibited Activities

You agree that you will not, and will not permit others to:

  • Probe, scan, or test the vulnerability of any system or network related to the Service or the App.
  • Breach or circumvent authentication, security, or access controls.
  • Access, tamper with, or use non-public areas of the Service or the App without authorization.
  • Interfere with or disrupt the integrity or performance of the Service, the App, or the data of other users, including by transmitting malware, viruses, worms, or other harmful code.
  • Use automated means (including scraping, bots, or scripts) to access the Service except through officially supported APIs.
  • Send spam, unsolicited communications, or deceptive messages (including phishing or spoofing).
  • Misrepresent your identity or affiliation.
  • Circumvent usage limits, quotas, or billing mechanisms, or use the Service beyond the scope of your subscription.
  • Resell, sublicense, or provide the Service or the App to third parties without explicit written authorization from QLands.
  • Upload, store, transmit, or share content that is unlawful, abusive, defamatory, obscene, sexually explicit, or promotes violence, hatred, or discrimination.
  • Infringe or violate the intellectual property, privacy, or other rights of any third party.
  • Use the Service or the App for activities that could result in physical harm, death, or serious injury.
  • Use the App to collect data about any individual without the notice and consent required by applicable law, or to harass, abuse, stalk, threaten, or surveil any individual, or otherwise to violate any person's rights of privacy or publicity.
  • Use the App's device permissions (including camera, microphone, location, and photo library) for any purpose other than the data-collection functionality of a form you are authorized to administer, including any covert or non-consensual recording.
  • Violate the terms of any third-party server or service you connect to using the App.
  • Violate the applicable terms of the platform from which you obtained the App, including the Apple Media Services Terms and Conditions (Apple App Store) or the Google Play Terms of Service (Google Play).
  • Use the Service or the App in a manner that QLands reasonably determines to be inconsistent with acceptable business or ethical practices.

3. Data Responsibility

You are solely responsible for the data you collect, upload, or process using the Service or the App. You represent and warrant that you have all necessary rights, permissions, and consents to process such data, including compliance with data protection, consent, and child protection laws, and including any approval required from an applicable ethical review body.

Where you configure the App to connect to a server not operated by QLands, you are responsible for the handling of that data by the operator of that server, and QLands has no access to or responsibility for it.

4. Enforcement

QLands reserves the right to investigate any suspected violation of this AUP. Violations may result in suspension or termination of access to the Service or the App, without notice, and may include removal of content, account restrictions, revocation of licenses, or termination of applicable agreements.

5. Changes to this Policy

We may update this AUP from time to time. Material changes will be communicated through the Service, the App, or by other reasonable means. Continued use after the changes take effect constitutes acceptance of the revised AUP.
